New statutory Sick pay legislation for Irish businesses: What you need to know

In March 2022, the Irish government approved a new Bill that grants all workers the right to paid sick leave. Created by The Tánaiste and Minister for Enterprise, Trade and Employment, the legislation will allow Irish employees to benefit from mandatory sick pay, the same as their counterparts in other European countries.

What’s in the new scheme for statutory sick pay in Ireland?

Under the new legislation, Irish workers have a right to:

  • Paid sick leave of up to three working days per year in 2023. This will rise to five working days in 2024, seven days in 2025 and 10 in 2026. It will be possible to take leave either on consecutive or non-consecutive working days.
  • Have 70% of their usual wages paid by employers, up to a maximum of €110 per day.
  • Lodge a complaint with the Workplace Relations Commission if sick pay is not made available to them, or they feel their employer has not complied with the legislation in some other way.

This is different to the previous legislation where Irish employees had no right to be paid while you were on sick leave from work. An employee whose employer didn’t provide paid sick leave could apply for Illness Benefit.

With the new legislation now in full effect, organisations across Ireland will need to understand their responsibilities to their people and how they can ensure they remain compliant with statutory sick pay requirements.
